Tarik Sheppard v United States Tennis Association
Tarik Sheppard, Respondent v USTA et al., Appellants 2019-09398. Index No. 716333/18. Appellate Division of the Supreme Court of New York, Second Department. The plaintiff, Tarik Sheppard, sued the USTA for alleged racial discrimination. As part of his lawsuit, his "second cause of action" claimed that the USTA was liable for negligent hiring and training of the employee involved. The USTA asked the court to throw this specific claim out early (a motion to dismiss for failure to state a claim under New York's CPLR 3211(a)(7)). The trial court originally said no and allowed the claim to move forward. The USTA appealed that decision.
